Terms of use

These terms apply when you use the Everpace Android app, the Everpace Garmin watch app and Everpace Pro (together, "Everpace"). Everpace is made by Mykhailo Nester ("we"). By installing or using Everpace you agree to these terms. If you don't agree, please don't use it.

Using Everpace

We give you a personal, non-transferable right to use Everpace on your own devices for your own training. Please don't copy, resell, reverse-engineer or misuse the app, and don't use it to break the law.

The core of Everpace is free: logging, the watch app, plans, history and personal records. We intend to keep it free.

Everpace Pro

Training at your own risk

Everpace is a training log, not medical or coaching advice. Estimated maximums, suggested loads, heart-rate zones and other numbers are estimates and may be wrong. Train within your limits, follow your coach, and check with a doctor before starting or changing an exercise programme. You are responsible for how you train, and we are not liable for injuries.

Your data

Your workouts are stored on your device, and you are responsible for keeping your own backups. What leaves your device, and how to delete it, is explained in the privacy policy and on Delete your data.

Garmin and other services

The watch app runs on Garmin devices and talks to the phone through Garmin Connect. Garmin, Google Play and other third-party services have their own terms, and we are not responsible for them or for their availability.

No warranty

Everpace is provided "as is" and "as available". We work to keep it reliable, but we don't promise that it will be error-free, always available, or that data will never be lost.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost data. Our total liability is limited to what you paid for Everpace Pro in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that cannot be excluded.

Ending

You can stop using Everpace at any time by uninstalling it and cancelling Pro in Google Play. We may stop offering Everpace or parts of it. If we stop offering Pro, we will tell subscribers in advance.

Changes

We may update these terms. The effective date at the top will change, and important changes will be announced in the app. If you keep using Everpace after a change, you accept the new terms.
